How do I make a request to Council under the Data Protection Act?

Under the Data Protection Act (subject to certain exemptions) you have a right to be told whether any personal information is held about you, the reason why it is being held and who uses that information.

Requests for access to personal information must be made in writing by the person concerned. This written application should contain the name and contact details of the applicant and enough detail to identify the personal information being sought. The Council is only required to give you the information you are seeking if it is satisfied as to your identity.

To help the Council to establish your identity, please enclose with your request copies of two of the following documents which between them, confirm your name, address and date of birth:

§        Medical Card,

§        Birth or Adoption Certificate

§        Utility Bill

§        Passport

§        or any other document bearing the above details.

Clear photocopies of documents are acceptable.

PLEASE DO NOT SEND ORIGINAL DOCUMENTS

The Council has produced a "Subject Access Request Form" to help facilitate the process and a copy can be obtained from the Council Offices, 7 Connell Street, Limavady (028 777 22226).

The Council is not required to provide information if someone else can be identified from it, unless that person consents to the disclosure, and we may deny access to personal information where this is allowed by the Data Protection Act 1998.

In any event, we will respond to your application within 40 days if you have provided us with sufficient information relating to your identity, and to assist us in locating the required information, if any.
